Many have wondered if Prosecutor Worthy will charge Mayor Kilpatrick but what will she charge him with. Will it be a felony such as perjury or official misconduct or will it be a misdemeanor like neglect of duty or obstruction of justice? Under the city charter a conviction on a misdemeanor would not require that Mayor Kilpatrick relinquish his position as Mayor, however a conviction on a felony would. Or malfeasance by a public official could lead the way to Mayor Kilpatrick either leaving or being removed from office.
According to what we hear on Monday morning at 11:00am Wayne County Prosecutor Kym Worthy will charge Mayor Kilpatrick with 5 counts.
(1).Three charges,Perjury
(2).One charge, Obstruction of Justice
(3).One charge, Official misconduct/malfeasance
According to some Prosecutor Worthy will try the case against Mayor Kilpatrick herself. As for others who may be charged speculation is running rampant that several of the attorney's may also face charges. The biggest surprise to many will be the charges against Detroit Police Deputy Chief Shereece Fleming-Freman. Fleming-Freman apparently played a role in the text scandal as the Detroit Free Press has pointed out. Also there will be some interesting names on the witness list for the prosecution. But the question that no one seems to know the answer to is what role, if any will the feds play in Monday's announcement or will they wait to do their own thing.
Why are the feds even a consideration? These words by Mayor Kilpatrick in a text message to Christine Beatty, " Bobby will strategically lose a bid". Sounds like public corruption and not that they need it but as an added bonus if it can be shown that any of those bids involved federal dollars they absolutely have to respond. Clearly Kilpatrick expects some intervention from the feds-why else would he hire a $700/hr attorney out of Chicago who is a retired U.S. Attorney. He needs someone who is familiar with federal procedures and can find their way around a federal courtroom.
Beatty got bad advice from Commander
Deputy Chief Fleming-Freman advised Beatty to fire Brown..
New text messages printed by the Detroit free Press reveal there was Conversation prior to the firing of Gary Brown between Chief of Staff Christine Beatty and then Detroit Police Commander, now Deputy Chief, Shereece Fleming-Freman with Fleming-Freman urging Beatty to fire Brown immediately. Apparently Beatty sought advice on whether she could fire Brown and she was told she could and was urged to do it by Fleming-Freman. Fleming-Freman testified under oath in a deposition given for the whistleblowers case that she had no knowledge of the firing prior to it happening and that she had never discussed Brown being fired with anyone. According to sources Fleming-Freman will be charged on Monday.
Oliver undermined by Bully-Cummings and Commander Fleming-Freman
Also other text messages published by the Detroit Free Press show that then Assistant Chief Ella Bully-Cummings discussed with Beatty buying the first lady Carlita Kilpatrick a Navigator from the police department budget. Bully, reported asked Beatty," what kind of car does she want?"Oliver who was chief at the time claims he objected to this purchase when approached by the mayor and he told him no. Oliver has now become aware because of the text messages of the plotting behind his back by Bully-Cummings and others to get rid of him. The text show that Bully-Cummings and Fleming-Freman routinely consulted with Beatty behind Oliver's back. Ultimately a Red Navigator was purchased for Mayor Kilpatrick from the police department budget after Oliver left the department and Bully-Cummings became chief.
More than just a high School crush?
They say that this scandal Detroit is in the midst of currently could've been avoided if two people who reportedly loved each other back in high school had just got this thing figured out then. From all indications Mayor Kwame Kilpatrick and Christine Beatty have been an item since Cass Technical High School. Where this thing goes off the road is when they went to different colleges. She went to Howard University and he went to Florida A&M. That's where he met Carlita and she got pregnant resulting in marriage. However the feelings for Christine never waned. They hooked back up when he became a State Representative . According to some, and clearly verified by the text messages, that love grew stronger resulting in the apparent extra-marital affair and the resulting scandal. Along the way Christine got married to Lou but they divorced in 2006 after the rumors began to spread, and backed up by the deposition given by Officer Walt Harris, about Mayor Kilpatrick making late night trips to the Beatty home. According to sources in the text messages he talks of someday marrying Christine; in those same text messages they also allegedly carried on conversations about his current wife Carlita.
